Tennyson Gallery Show Agreement

 

The following is an agreement between ________________, Artist, and Tennyson Gallery. The Gallery shall permit exhibition / and promotion of the Artists work on gallery premises under the following conditions:

  1. Commission. The Gallery will pay the artist 50% of the retail price of any work sold. The Artist shall include framing, materials, etc. as part of their retail price quoted to the gallery.
  2. Time Frame. The Artist and the Gallery agree that the items catalogued will remain on consignment for the length of time stated in the contract agreement summary, or until such time as further agreement to be made.   
  3. Delivery Date and Requirements. Art and CD with digital images of each piece in inventory will be delivered to the gallery. The artists will not request the return of their work before the end of this term.

§         CD with digital photograph of each piece delivered (for security, inventory, and insurance / damage assessment) – highly desirable but not required. Specs: 72 dpi, largest size 4” tall, 4” wide, Prefer jpg. Save file name in small letters and no spaces, and 15 letters or less, please.

___ Packing Materials. Artwork will be properly wrapped and/or packaged, and packing materials will remain with the gallery during the term of the contract. Packing materials will be used to wrap sold artwork for customers.

  1. Artwork Condition. All artwork will be “ready for display.” For example, if a 2-D canvas, it will be ready to hang with D-hooks and wire, wrapped or framed. Matted, unframed prints shall be wrapped in protective, clear material. NOTE: We encourage framed work to be framed simply but professionally. You decide if the Gallery can give the buyer the option to buy the artwork without the frame if desired. In this case, in the inventory, provide a framed and unframed price.
  2. Pick up Date. Artist will pick up all work no sooner than the Friday before the First Friday of the following month and no later the Saturday before the First Friday of the month, unless other arrangements have been made with the gallery. If the artist fails to pick up his/her unsold work by the end of the deadline (unless specific arrangements have been made), the art will become the property of Tennyson Gallery!
  3. Artist Reception. The Artist will be onsite at the Gallery during opening night during the entire opening event. Unless otherwise noted, openings will be scheduled from 6pm – 9pm (artist required to be on site until 9pm) during the 1st Friday of the month.    
  4. OPENING NIGHT DISCOUNT.  Unless noted otherwise on the inventory by the artist, the Gallery has the authority to discount Artist’s work if work is sold and paid for during Opening Night.
  5. PRIVATE EVENTS DISCOUNT.  The Gallery frequently books private events. This creates additional exposure for Artists’ work. The Gallery likes to extend a “private event one-night-only” incentive to encourage event guests to purchase art. Unless noted otherwise on the inventory by artist, the Gallery has the authority to discount Artist’s work up to the percentage stated on inventory if work is sold and paid for during the private event.
  6.  “HAGGLING RANGE”.  The Gallery has the authority to discount Artist’s work up to amount noted on inventory in order to close a sale.]
  7. MARKETING DIGITAL IMAGES. Artist will provide digital photographs of work for marketing materials and Gallery web site (At least 2 images in digital format (jpg or tiff no bigger than 72 dpi per) delivered on disc at least 6 weeks prior to show starting date.) NOTE: If the Gallery needs to create digital images and/or measure artwork, we will do so at a fee of $25 per hour with a minimum charge of one hour.
  8. Artist Support Materials. (To enable the Gallery to best represent you and your work)

 Desired. portfolio summary, preferably 8 ½ x 11’ binder or CD

 REQUIRED one paragraph artist statement about your approach to the work. A full resume for press placement purposes is highly desirable also, if not already provided. (Please provide in electronic Word doc at least 6 weeks prior to show.)

 Press Release (to be sent to Artist media contacts. We welcome artists taking the initiative to promote the show to the media and other marketing vehicles (such as flyers for posting.)

  1. Marketing Commitments. The Gallery agrees to market shows, conduct advertising, send press releases to media contacts and to distribute invitations to Gallery database. Artist agrees to distribute invitations to his/her database as well. The Gallery will email marketing collateral to Artist for printing and/or distribution.
  2. Payment. Notice of sales and payment of all monies due shall be made not more than 30 days after receipt of full payment to the Gallery and / or end-of-show. Checks will be cut monthly. For works that are paid for by the customer’s credit card, the Gallery incurs a 4% fee. The Gallery will split this charge with the Artist ONLY if credit card fees are incurred. The Gallery will be responsible for all sales tax. Artist is responsible for reporting all income tax.
  3. Insurance. The Artist is responsible for insuring all artwork. The Gallery assumes no responsibility for establishing the value of any artwork for insurance purposes or paying any disputed difference. Certificates of Authenticity provided by Artist are highly encouraged.
  4. Custom Work Commissions. The Artist agrees to pay the Gallery 30% of any commission resulting from artist’s relationship with the Gallery. ANY commissions or other sales generated as a result of the Artist’s relationship with the Gallery shall be subject to this Agreement. Corporate Account commissions will also be 30% unless negotiated differently.
  5. Termination. The agreement may be terminated at any time by either party by means of written notification. All accounts shall be settled and any unsold works picked up by the Artist within 7 days of agreed termination. The Artist shall give the Gallery at least 24 hours notice when delivering and picking up work. The artist will be responsible for any wrapping, shipping and handling charges. Any shipping and handling charges that result from a sale to deliver artwork to a Buyer will be paid by the Buyer unless the Artist makes different arrangements.

Tennyson Gallery Reserves the Right to:

  • Negotiate prices with artist
  • Use digital images for marketing purposes, including posting samples to Gallery web site. Work will be copyright protected on the web site.
  • Reject work
  • Display work without artists’ input unless we seek it

 

Other considerations

  • If artist has display cases, pedestals, or shelving units that uniquely display the art, the Gallery is open to working with the artist on this.
  • All Gallery policies and agreements as posted on our web site will apply to all artists and work.
  • NO telephone numbers, web site addresses, or emails are to be provided on your materials or given to customers. The artist’s relationship is with Tennyson Gallery, as is the customer’s relationship.
